Terms of Use

Welcome to Driveway. This App is owned and operated by Driveway, LLC (“we,” or “us”). These Terms of Use (“Terms”) govern your use of our App, hereafter referred to as “the App”. These Terms include information about usage, licensing, and intellectual property. Please read these Terms carefully. By using the App, you consent to these legally binding Terms as well as our Privacy Policy, which is hereby incorporated.

Consent and Capacity

In order to use our services, you must be at least thirteen (13). Your use of our services is conditioned on your acceptance of these Terms. If you do not agree with these Terms, please discontinue your use of the App. By using our services, you warrant that you are entering into a binding contract with Driveway, LLC.

Where required by law, we may obtain age information from Apple or Google Play and restrict features based on your age category. Hosting events and receiving payouts require that you are 18 or older and able to form a binding contract.

Intellectual Property Rights

Driveway, LLC’s trademarks, trade names, logos, and other intellectual property incorporated into the App are the sole property of Driveway, LLC or its licensors and are protected under copyright, trademark, trade secret, and other intellectual property laws. Copying or distributing any material, illustrations, photographs, video, or content from the App without consent is strictly prohibited.

User Content

Driveway allows its users to post, upload, or comment on content on the App. This user-generated content includes, but is not limited to comments and pictures. By posting on the App, you grant Driveway, LLC a perpetual, nonexclusive, unrestricted, worldwide license to any and all of the user content you post. You acknowledge that you are the sole owner of any copyrights and that your content does not infringe the rights of any third parties.

User Responsibilities

Users of the App agree to the following guidelines:

1. You will keep your username and password confidential. You will not share this information with any other person.
2. You will not use another user’s login and registration information.
3. You will not create fake accounts for the purpose of spamming users or visitors, collecting personal information with or without consent, or any other deceptive practices.
4. You will not circumvent, evade, disable, or otherwise interfere with the security of the App.
5. You will not infringe the intellectual property rights of others.

You may delete your account from the app Settings or by following instructions at Account Deletion.

THE APP, ITS CONTENT, AND ALL THE MATERIALS ARE “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OR GUARANTEE. YOU ACCESS THE APP AT YOUR OWN RISK UNDERSTANDING THAT DRIVEWAY, LLC DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PROVIDED BY APPLICABLE LAW, DRIVEWAY, LLC DOES NOT ACCEPT LIABILITY FOR LOSS OR DAMAGE OF ANY KIND, BE IT DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY, INCIDENTAL, ACTUAL, PUNITIVE, OR OTHERWISE. THE FULL ASSUMPTION OF RISK AND THEREFORE RESPONSIBILITY LIES WITH YOU, THE USER AND VISITOR.

• We aren’t responsible for what others do or say.
• Our legal liability is limited.
• In any case, our total liability won’t exceed $100 or the amount you’ve paid us in the past year—whichever is greater.

Dispute Resolution

We believe that it is beneficial to all parties to quickly resolve any potential disputes as efficiently and cost-effectively as possible. If informal attempts fail, you agree to submit any claim, dispute, or controversy to binding arbitration.

YOU AGREE TO WAIVE ANY AND ALL RIGHTS TO A JURY TRIAL YOU MAY HAVE IN ANY AND ALL JUDICIAL PROCEDURES AND PROCEEDINGS RELATED TO ANY DISPUTE ARISING FROM YOUR USE OF THE APP UNDER THESE TERMS.

Choice of Law

These Terms and any disputes arising from the use of THE APP are governed by and construed according to the law of the state of Utah. Each party agrees to submit to the courts of the state of Utah and that the state of Utah has personal jurisdiction over the matter.

Objectionable Content

Users may not post, share, or transmit any content that includes (but is not limited to):

• Hate speech, harassment, or bullying
• Threats or promotion of violence
• Nudity, pornography, or sexually explicit material
• Illegal activities or promotion of illegal substances
• Spam, misleading, or fraudulent information

End User License Agreement (EULA)

Before using this app, you must agree to our Terms of Service and End User License Agreement (EULA). This includes a zero-tolerance policy for objectionable content and abusive behavior.

Community Safety and Content Moderation

Our platform is dedicated to fostering a safe, positive, and engaging community environment. Therefore, we maintain a zero-tolerance policy for objectionable content and abusive user behavior.

User Obligations

By submitting, uploading, or posting any content to the application, the user represents and warrants that their content:

• Is not unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable.
• Does not promote or encourage illegal activities or violate any applicable local, state, national, or international law.

Enforcement and Consequences

The user understands and agrees to the following enforcement provisions, which shall be applied strictly and at our sole discretion:

• Content Review and Removal: Content flagged by other users or our moderation systems will be subject to internal review. If the content is deemed to be objectionable, abusive, or in violation of this Agreement, it will be immediately removed without prior notification to the user.
• Account Action: We reserve the right to take any action necessary, including, but not limited to, temporary suspension or permanent termination of the user’s account and access to the application, for any violation of this policy.
• Waiver of Appeal: The user waives any right to challenge or appeal a decision regarding content removal or account action resulting from a violation of this Community Safety policy.

Events and Payments

Paid event registration and host payouts are processed through third-party payment providers (including Stripe). Hosts are responsible for accurate event details, refunds according to stated policies, and applicable tax obligations.
